AI Copyright Troll Trap: Batch-Generating Images to Set Traps in Image Repositories and Reverse-Sue for Damages

The victims are primarily self-media creators operating individually or in small teams, small-to-medium-sized e-commerce merchants, and content incubation agencies. Typically lacking dedicated copyright auditing capabilities, they download images from so-called free, copyright-free image libraries or web search engines to make article illustrations or product detail pages look appealing. The psychological vulnerability of the victims lies in their fear of lawsuits and desire to sweep matters under the rug. When they receive infringement notification letters bearing official seals and lawyer signatures, they often choose to pay settlement fees ranging from thousands to tens of thousands of yuan according to the other party's demands, because they cannot afford the high costs of litigation time and legal fees. Ultimately, they are preyed upon by extortion disguised in the cloak of legitimate rights protection.

骗局怎么运作

  • Gray-industry syndicates use AI drawing tools like Midjourney and Stable Diffusion, entering general prompt words to batch-generate tens of thousands of highly versatile images—such as landscapes, still lifes, and abstract backgrounds—at low or even zero marginal cost. They automatically remove AI traces or modify metadata, disguising them as manual original works ready for use.
  • The syndicates batch-upload these AI-generated images to self-built image libraries or third-party stock platforms with lax review standards, deliberately labeling them as free for commercial use or placing them in public areas without copyright markings. This lures copyright-unaware self-media creators and e-commerce merchants into downloading and using them, causing them to fall into the trap.
  • The syndicates deploy automated crawler programs and image recognition systems to monitor major self-media and e-commerce platforms across the entire internet 24/7. They capture the hash values or perceptual features of all article illustrations or product detail page images, and automatically compare them with their own trap image library to identify infringement targets.
  • Once a match is found showing a self-media account using their images, the syndicate immediately uses automated programs to batch-generate infringement notification letters or lawyer's letters. These letters include acquired copyright registration certificates or upload timestamps, demanding compensation based on a standard of several thousand yuan per image and threatening lawsuits.
  • Gray-industry syndicates leverage information asymmetry to exert psychological pressure. During communications, they hint at the massive statutory damages the self-media faces, refuse any reasonable license price negotiations, and use the initiation of litigation filing procedures to pressure victims who are eager to settle out of court into paying the settlement fees, achieving scaled extortion.

  • 🚩 In the received infringement notices, the attached original images have highly similar generation records across major AI painting communities, and their composition elements are extremely templated, showing typical AI-generated traces.
  • 🚩 The issuing institution is often a copyright management company registered not long ago or collaborates with some obscure law firm. Its official website content is rudimentary, and its main business revolves almost entirely around image infringement rights protection and compensation claims.
  • 🚩 The demanded compensation amount far exceeds the market licensing price of normal image libraries, often reaching several thousand or even tens of thousands of yuan per image, and they refuse to provide channels for purchasing normal licenses, accepting only one-time settlement remittances.
  • 🚩 The so-called creative process shown in the evidence often consists of only a few finished images with timestamps, lacking hand-drawn line drafts, layered source files, or traces of manual modification, and unable to explain specific creative ideas and steps.
  • 🚩 The download source of the complained photo is often an obscure website that was clearly marked as free and copyright-free at the time, while the infringing party later quietly tampered with the webpage status or used technical means to conceal evidence of the original public authorization.

真实案例

  • In March 2025, according to Tencent News reports, a self-media creator encountered an AI image copyright dispute and was sued by a well-known tech company for image infringement, facing a claim of 100,000 yuan. The party found that the images for which the other party claimed copyright were suspected of being AI-generated, and that the other party allegedly discovered them via crawler technology and directly sent high compensation demand letters, sparking widespread industry concern over AI copyright abuse extortion. • In April 2026, a Beijing court sentenced the first criminal case involving AI copyright infringement. Party Jia and others used AI style-transfer techniques to copy others' artistic works, producing and selling puzzles for a profit of 270,000 yuan. Although this case represents reverse infringement punishment, it also reveals that the costs of AI image generation and copying are low, making them highly susceptible to being used by criminals for copyright arbitrage and trap setting. • According to 36Kr reports, AI painting platforms themselves have also been placed in the defendant's seat. Some platforms were sued by plaintiffs on the grounds that the platforms failed to fulfill their auditing obligations because AI-generated images uploaded by users were suspected of plagiarism or caused infringement disputes. Some gray-industry syndicates exploit loopholes in image library and platform reviews to shift the blame for AI-generated images onto platforms or make cross-industry compensation claims.
  • In November 2025, starry sky photographer Dai Jianfeng's copyright infringement lawsuit against Visual China ushered in its first-instance judgment. Previously, in August 2023, Dai Jianfeng used his own works but received a letter from Visual China accusing him of infringement and claiming over 80,000 yuan in compensation. The court ruled that the compensation claim was clearly improper, and concurrently ruled that Visual China's illegal sale of his photos infringed upon the right of communication on information networks and the right of authorship, ordering Visual China and two other companies to jointly compensate and issue a public apology, concluding the two-year lawsuit in final judgment. Official Stance

  • On August 17, 2025, China National Radio published a report titled "Selling via AI Style Transfer, Copyright Infringement Convicted and Sentenced", warning that using AI technology to generate images and conduct improper rights protection or infringing behaviors will face severe legal punishment.
  • On April 22, 2026, Sina Finance reported that "Using AI to Generate Infringing Images and Producing Puzzles for Sale Yielded 270,000 Yuan in Profit, 4 Persons Sentenced Respectively", judicial authorities released a clear enforcement signal through conviction and sentencing, cracking down hard on the AI infringement gray industry.
  • In March 2025, Tencent News and multiple other media outlets published reports on "New Developments in 360 Company's AI Image Copyright Dispute". Multiple legal experts issued warnings in the reports that copyright claims over AI-generated content should be approached with caution to prevent rights protection from becoming distorted into extortion.

How to Protect Yourself

  • ✅ When selecting illustrations, self-media and merchants should prioritize large, well-known image library platforms with clear backgrounds, and never download images involving commercial use from so-called free image libraries with unknown sources and no filing information.
  • ✅ After receiving a lawyer's letter for image infringement, strictly avoid transferring money immediately to settle privately. Use image recognition tools immediately to check whether the image has multiple versions circulating or if there is a possibility of it being generated with one click by other AI platforms.
  • ✅ Require the other party to provide a complete original evidence chain, including non-AI-generated proofs such as layered source files, hand-drawn sketches, and continuous creation time records; certificate statements alone cannot constitute a complete ownership chain.
  • ✅ If threatened with a lawsuit by the other party, proactively seek the intervention of a professional intellectual property lawyer, or even report the copyright scam suspected of extortion to local public security organs, resolutely fighting back through judicial channels.
